This document defines the general Terms of Service pertaining to the ARTE DISTRIBUTION website provided by Arte France Développement – a limited company with a capital of 777.750, euros - R.C.S. Nanterre: 388 249 146- 8, rue Marceau - 92785 Issy-les-Moulineaux cedex 9 – France

Preamble

These Terms of Service (hereinafter referred to as "TOS") govern the use of the ARTE DISTRIBUTION website and may be modified at any time by ARTE France Développement in order to take into account any legal, jurisprudential, editorial and/or technical changes. These modifications are provided to users by simply putting them online, without the users being notified in advance. The latest version should be consulted regularly.

ARTE France Développement offers on the website https://distribution.arte.tv (hereinafter referred to as "the ARTE DISTRIBUTION Website") a space dedicated to media professionals who wish to acquire exploitation rights, allowing them to have access to online viewing of the programs offered by ARTE France and to download the various related marketing tools: line ups, press kits and flyers are available on the website.

The ARTE DISTRIBUTION website notably offers:

  • Preview trailers
  • Full videos of most of the programs available on the website
  • Pre-sales files, thematic or market-related line-ups, flyers and downloadable catalogs.

1. Registration and accessibility of the ARTE DISTRIBUTION website

1.1. Accessibility of the website

The ARTE DISTRIBUTION website is accessible to all Internet users.

1.2. Registration of media professionals for program viewing

However, viewing of the full programs is reserved to media professionals; it is subject to the registration/creation of an account by each new user. To do so, they must click on the "My account" tab in the side menu of the ARTE DISTRIBUTION website, then on "Create an account" or at the following address: https://distribution.arte.tv

When registering, the media professional must complete the form reserved for this purpose and provide the following information, corresponding to the mandatory fields:

  • Title, Surname and first name
  • Organization, profession
  • E-mail address which will then be the identifier of the media professional
  • Password
  • Company, telephone, country
  • Areas of interest

After validation of the registration by ARTE DISTRIBUTION, the identifier and password – strictly reserved to the media professional themselves – will be sent to them by a confirmation e-mail to the address he indicated when registering.

1.3. ARTE DISTRIBUTION Newsletter

When registering, a check box is provided to the media professional if they wish to receive the ARTE DISTRIBUTION newsletter with a link to these TOS.

On the understanding that the media professional has provided reliable information to contact them if necessary.

Once registered, they will be able to connect to this part of the website by entering their e-mail address and password. They can unsubscribe from the site or newsletter at any time by sending an e-mail to the following address: infosales@artefrance.fr

2. Responsibilities and warranties

The media professional is responsible for any misuse and/or action carried out under their ID. They are also solely responsible for the use made by themselves (or by any third party) of their password. In the event of a misuse of their identification and/or password or usurpation of their identity, the media professional agrees to notify ARTE France without delay.

ARTE France Développement is not responsible nor liable for:

  • an unavailability or malfunction of the ARTE DISTRIBUTION website, regardless of the cause;
  • the loss of point data;
  • consequences from any virus;
  • a case of Force Majeure as defined by the jurisprudence of the French Court of Cassation.

3. Protection of personal data

3.1. Information collected to allow viewing full videos

The information collected by ARTE France Développement from media professionals and as described in article 1.2 of these TOS is processed for the following purposes: access to program viewing and the establishment of statistics on aforementioned viewing by ARTE France Développement's International Distribution. The information is kept only as long as necessary for the purposes set out above, i.e. for the duration of the media professional's registration to his ARTE DISTRIBUTION account.

In accordance with Law No. 78-17 of January 6, 1978, on data processing, files and freedoms (as amended) and Regulation (EU) 2016/679 on the protection of personal data, you have the following rights: rights to access, modify, and oppose the information as well as a right to erasure (right to be forgotten), a right to define directives applicable after death and a right to limit processing.

3.2. The information collected for the ARTE DISTRIBUTION newsletter sent to media professionals.

The purpose of the information collected by Arte France Développement from media professionals and as described in Article 1.3 of these TOS is to send an ARTE DISTRIBUTION newsletter if the media professional has ticked the "accept" box. This information is collected on the basis of the media journalist's consent, which may be withdrawn at any time. The information is kept only as long as necessary for the purposes set out above, i.e. for 3 (three) years from the last contact made by the media professional.

In accordance with Law No. 78-17 of January 6, 1978, on data processing, files and freedoms (as amended) and Regulation (EU) 2016/679 on the protection of personal data, you have the following rights: rights to access, modify, and oppose the information as well as a right to erasure (right to be forgotten), a right to define directives applicable after death, a right to limit processing and a right to data portability.

4. Exercise of rights

To exercise your rights, you can use this form or a postal letter addressed to: ARTE France Développement – Délégué à la protection des données (DPO) – 8 rue Marceau 92185 Issy Les Moulineaux cedex 9 – France.

In accordance with the current legislation, please send your signed request, accompanied by a copy of your identity document and specify the address to which the reply should be sent. ARTE France Développement has a period of 1 (one) month following receipt of the request to reply.

You have the right to file a complaint with the Commission Nationale de l'Informatique et des Liberté (CNIL).

5. Intellectual property

All elements of the ARTE DISTRIBUTION website – more specifically the sounds, videos, still images or animations reproduced on the website – are protected by copyright and intellectual property rights throughout the world.

As such, and in accordance with the provisions of the Intellectual Property Code:

  • any total or partial reproduction of the ARTE DISTRIBUTION website is strictly prohibited except in the cases expressly defined by these TOS.
  • the user agrees not to modify, transmit, sell or distribute the said website or the elements that make it up in any way whatsoever.

6. Modification of the ARTE DISTRIBUTION website

ARTE France Développement reserves the right to modify or interrupt (temporarily, sporadically or permanently) access to the ARTE DISTRIBUTION website (or all, or part of it) with or without notice at any time. The user therefore acknowledges that ARTE is not liable to them or any other party for any modification, deletion or interruption of the website.

7. Applicable law - Dispute

These TOS are subject to French law.

For users acting as professionals, disputes arising from the interpretation or application of these TOS shall be submitted to the competent courts in Paris.
